Welcome to KPaja. These Terms and Conditions of Use ("Terms") govern your access to and use of our website, services, features, content, and community.

By accessing, browsing, registering, creating an account, uploading content, interacting with other users, or using any feature of KPaja, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree with any of these Terms, you must not use the platform.

1. Nature of the Platform

KPaja may take reasonable measures to restrict or prevent access when there are indications that a person does not meet the age requirement.

3. User Accounts

When creating an account, you are responsible for providing accurate information and maintaining the security of your credentials.

Users may use a username or alias. You are not required to publicly use your legal name unless a specific feature or legal requirement requires it.

You must not:

• Deliberately impersonate another person.

• Use an identity for the purpose of committing fraud or deception.

• Share your login credentials with third parties.

• Knowingly allow another person to use your account to violate these Terms.

• Create multiple accounts for the purpose of circumventing a suspension or restriction.

You are responsible for maintaining the confidentiality of your password and for activities carried out through your account, unless you can demonstrate that unauthorized access occurred beyond your control.

If you suspect that your account has been compromised, you should notify KPaja as soon as possible.

4. User-Generated Content

KPaja allows registered users to publish certain types of content, including photographs, videos, text, comments, profiles, and other materials ("User Content").

Each user is responsible for the content they publish.

By uploading content, you represent and warrant that:

1. You are of the legal age required to use the platform.

2. All persons depicted in the content are adults.

3. All persons depicted participated voluntarily.

4. You have all necessary permissions, authorizations, image rights, copyrights, and other rights required to publish the content.

5. The publication of the content does not infringe the rights of any third party.

6. The content complies with these Terms and applicable law.

7. You did not obtain the content through unauthorized access, theft, hacking, or any other unlawful means.

Publishing content belonging to another person without authorization may constitute a violation of these Terms and, depending on the circumstances, a violation of applicable law.

5. Consent and Rights of Persons Depicted

You may not use KPaja to publish intimate material depicting a person without their consent.

It is prohibited to publish, request, distribute, or promote intimate content obtained through:

• Secret recording.

• Unauthorized access to devices or accounts.

• Theft of private material.

• Threats or extortion.

• Coercion.

• Deception intended to obtain intimate material.

• Any other means contrary to the wishes of the person depicted.

If a person believes that they appear in content published on KPaja without their authorization, they may use our reporting mechanisms to request a review.

KPaja may restrict or temporarily remove content while a report is being investigated.

6. Strictly Prohibited Content

It is strictly prohibited to use KPaja to publish, store, request, distribute, promote, or facilitate illegal content or activities.

Among other things, the following are prohibited:

• Any child sexual abuse or exploitation material.

• Any sexual content involving minors.

• Content that sexualizes minors, regardless of whether it is real, digitally generated, manipulated, or presented as fiction when its distribution is prohibited by applicable law.

• Intimate content published without consent.

• Content involving sexual exploitation, trafficking, or coercion.

• Rape or sexual acts carried out through force or coercion.

• Content depicting non-consensual sexual acts when its distribution is unlawful.

• Bestiality or other unlawful sexual acts.

• Content constituting a criminal offense.

• Threats, extortion, or blackmail.

• Doxxing or malicious publication of another person's personal information.

• Malware, phishing, fraud, or activities intended to compromise accounts or systems.

• Attacks against KPaja's infrastructure.

• Spam or automated abuse of the platform.

• Impersonation.

• Content that infringes copyrights, trademarks, image rights, or other third-party rights.

KPaja may remove or restrict any content that it reasonably considers to be contrary to these Terms, even when the legality of the material has not been finally determined by an authority.

7. Content Involving Minors

KPaja maintains a zero-tolerance policy regarding any child sexual abuse or exploitation material.

If content is detected or reported that may involve a minor:

• The content may be immediately restricted or removed.

• The associated account may be suspended or blocked.

• KPaja may preserve technical information and records related to the incident when appropriate.

• Where required by law or pursuant to a valid request from a competent authority, KPaja may provide information as legally required.

KPaja may cooperate with competent authorities in investigations involving illegal activities, in accordance with applicable law.

Users must not attempt to download, redistribute, store, or independently investigate material that may constitute evidence of child sexual abuse. Reports should be made through the mechanisms provided by KPaja or to the appropriate authorities.

8. Moderation

KPaja may use automated tools, detection systems, human moderators, user reports, and other mechanisms to identify potential violations.

However, due to the volume and nature of user-generated content, KPaja does not guarantee that all content will be reviewed before appearing on the platform.

The absence of prior review does not mean that KPaja approves, endorses, or guarantees the legality of any content.

KPaja may:

• Remove content.

• Temporarily hide content.

• Limit its distribution.

• Suspend accounts.

• Block accounts.

• Restrict certain features.

• Request additional information.

• Take other reasonable measures to protect users and the platform.

Moderation measures may be taken with or without prior notice when necessary to protect community safety, preserve evidence, prevent harm, or comply with legal obligations.

9. Reports

Users may report content, accounts, or behavior that they believe violates these Terms.

Submitting a report does not guarantee that the reported content will be removed.

KPaja will evaluate reports using the information available and may request additional information when necessary.

To protect the privacy and safety of users, KPaja is not required to disclose the identity of the reporter to the reported user unless legally required to do so.

False, malicious, or systematically abusive reports intended to harm another user may also constitute a violation of these Terms.

10. Intellectual Property

Users retain whatever rights they are legally entitled to in the content they publish.

By uploading content to KPaja, you grant KPaja a limited, non-exclusive, worldwide, royalty-free license solely for the period necessary to host, store, process, reproduce, technically adapt, distribute, and display such content within the platform and to provide its services.

This license allows KPaja, among other things, to:

• Store the content.

• Generate thumbnails.

• Convert formats.

• Make necessary technical adaptations.

• Display the content to other users in accordance with privacy settings and platform features.

• Make technical backup copies.

KPaja does not acquire ownership of your content merely because it is published on the platform.

When you delete content, KPaja may retain technical copies for a reasonably necessary period for backups, security, abuse prevention, dispute resolution, or compliance with legal obligations.

11. Copyright Infringement

If you believe that content published on KPaja infringes your copyright or other intellectual property rights, you may submit a report through the mechanisms provided on the platform.

Reports should provide sufficient information to identify:

• The content being claimed.

• The right allegedly infringed.

• The reporter's relationship to that right.

• Contact information for the reporter.

• Any other information reasonably necessary to evaluate the claim.

KPaja may remove or restrict content when it determines that a valid infringement exists or when doing so is necessary to reduce legal risks.

12. Privacy and Technical Data

KPaja respects the privacy of its users and processes personal data in accordance with its Privacy Policy and applicable law.

To provide, protect, and maintain the platform, KPaja may process certain technical data related to use of the service.

Depending on the features used, this may include:

• Date and time of access.

KPaja does not require users to publicly disclose their legal name in order to use a username or alias.

13. Disclosure of Information Pursuant to Legal Requests

KPaja does not arbitrarily provide users' private information.

When a competent authority submits a valid legal request, KPaja may preserve and provide information as legally required.

Depending on the information available, this may include information associated with an account, technical records, IP addresses, dates and times of access, or other relevant information.

KPaja does not guarantee that it will always possess sufficient information to personally identify a user.

An IP address alone does not necessarily constitute an unequivocal identification of a person.

Where permitted by law, KPaja may notify the affected user of a request for information unless there is a legal or security reason preventing such notification.

14. Communications and Private Messages

KPaja may provide communication tools between users.

Private messages are intended for private communication between the participants.

However, the privacy of messages should not be interpreted as an absolute guarantee of confidentiality against:

• User reports.

• Security investigations.

• Abuse prevention.

• Platform-related incidents.

• Legal obligations.

• Valid requests from competent authorities.

KPaja may access or preserve information related to communications when there is a legitimate and proportionate reason to do so.

Administrative access to private information should, to the extent reasonably possible, be limited to circumstances necessary to resolve a report, protect users, investigate abuse, or comply with legal obligations.

15. Conduct Between Users

KPaja does not control personal relationships between users.

Users are responsible for their own interactions and must act respectfully and lawfully.

The platform may not be used to:

• Harass.

• Threaten.

• Extort.

• Blackmail.

• Persistently stalk or pursue other users.

• Obtain personal information through deception.

• Share third-party private information without authorization.

• Engage in illegal activities.

KPaja may intervene when an interaction violates these Terms or poses a reasonable risk to community safety.

16. Third-Party Links and Services

KPaja may include links, players, storage services, advertising, analytics tools, payment services, or other features provided by third parties.

KPaja does not necessarily control such services and does not guarantee their availability, security, content, or policies.

17. Advertising

Where a refund is applicable, it will be handled in accordance with the specific service terms and applicable law.

19. Service Availability

KPaja strives to keep the service continuously available but does not guarantee that the platform will be available at all times.

The service may be interrupted due to:

• Maintenance.

• Updates.

• Technical failures.

• Infrastructure issues.

• Cyberattacks.

• Issues involving third-party providers.

• Network outages.

• Circumstances beyond KPaja's reasonable control.

KPaja may modify, suspend, or discontinue features when necessary.

20. Limitation of Liability

To the maximum extent permitted by applicable law, KPaja, its operators, administrators, contributors, and service providers shall not be liable for indirect, incidental, special, consequential damages, or loss of profits arising from the use of, or inability to use, the platform.

KPaja also does not guarantee:

• The accuracy of content posted by users.

• The real identity of users.

• The legality of all third-party user-generated content.

• Continuous availability of the service.

• That all content will be reviewed before publication.

• That all users will act in good faith.

Nothing in these Terms is intended to exclude or limit any rights or liabilities that cannot legally be excluded or limited.

21. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless KPaja, its operators, and contributors from claims, damages, losses, costs, and reasonable expenses arising from:

• Your use of the platform.

• Content you publish.

• Your violation of these Terms.

• Infringement of third-party rights.

• Illegal use of your account.

• Your interactions with other users.

This provision is not intended to limit any rights granted to users under applicable law.

22. Account Suspension and Termination

KPaja may suspend or terminate an account when there are reasonable grounds to believe that:

• These Terms have been violated.

• Illegal activity has occurred.

• There is a risk to other users.

• The account is being used for fraud or abuse.

• An attempt is being made to circumvent a previous suspension.

• There is a threat to the security of the platform.

In serious cases, suspension may occur immediately and without prior notice.

Where reasonably possible, the user may request a review of the action.

Deleting an account does not necessarily mean that all associated technical records or backups will be immediately deleted, particularly where retention is necessary for security, fraud prevention, dispute resolution, or legal obligations.

23. Right to Appeal

When an account is suspended or a publication is removed, the user may request a review where KPaja provides an appeal mechanism for that action.

The request should clearly explain why the user believes the decision was incorrect.

KPaja may uphold the decision where security, legal, or user-protection reasons justify the action.

24. Automated Use and Scraping

The use of robots, crawlers, scrapers, scripts, or other automated systems to collect content or information from KPaja without prior authorization is prohibited.

The following are also prohibited:

• Circumventing security mechanisms.

• Generating artificial traffic.

• Making excessive requests.

• Mass extraction of content.

• Attempting to obtain private or temporary URLs.

• Interfering with the infrastructure.

KPaja may automatically limit or block activities that it considers abusive or harmful to the service.

25. Security

You are prohibited from attempting to:

• Access third-party accounts.

• Obtain passwords.

• Circumvent authentication mechanisms.

• Deploy malware.

• Conduct brute-force attacks.

• Conduct DDoS attacks.

• Exploit vulnerabilities for malicious purposes.

• Interfere with KPaja servers or services.

If you discover a security vulnerability, you are encouraged to report it responsibly to KPaja and to avoid accessing, modifying, or disclosing information belonging to third parties.

26. Changes to These Terms

KPaja may modify these Terms when necessary to reflect legal, technical, commercial, or functional changes.

The current version will be published on this page.

Where a change is material and applicable law requires additional notice, KPaja may provide such notice.

Continued use of the platform after the changes become effective means that you accept the updated version, except where applicable law requires a different procedure.

27. Severability

If any provision of these Terms is determined by a competent authority to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in effect to the maximum extent permitted by law.

28. Applicable Law

These Terms shall be interpreted in accordance with the laws applicable to KPaja and its relationship with its users.

Nothing in these Terms is intended to deprive a user of rights that cannot legally be excluded under the applicable laws of their jurisdiction.
